This Addendum is incorporated into and made part of the Prime Security Storage Rental Agreement above. All original rental
agreement terms, rental information, prices, fees, signatures, lease addendums, vehicle/RV addendum, heat/electrical addendum, and Wisconsin self-service storage statute language remain in effect unless expressly modified in writing by Operator.

31. Website Terms and Online Services Lessee acknowledges that Prime Security Storage may provide online reservations, online rental documents, payment portals, customer account access, gate access systems, email communication, text messaging, website information, and other digital services. Use of the website, online portal, payment system, gate system, or electronic rental process constitutes acceptance of this Agreement, all addendums, posted facility rules, and website policies.
32. Electronic Communications and Electronic Signatures Lessee consents to conduct business electronically with the operator. Electronic signatures, checkbox acceptance, online initials, electronic records, digital rental documents, online payments, and electronic notices shall have the same legal effect as handwritten signatures and paper records to the fullest extent permitted by law. Lessee agrees that checking an acceptance box, signing electronically, submitting a payment, reserving a unit, accessing the facility, or using online services may evidence acceptance of this Agreement.
33. SMS, Email, and Notice Consent By providing a phone number, email address, mailing address, or alternate contact information, Lessee consents to receive account communications, payment reminders, late notices, lien notices where permitted by law, security notices, facility updates, marketing communications, and operational messages by mail, email, phone, text message, or other lawful communication methods. Message and data rates may apply. Lessee remains responsible for keeping all contact information current and accurate.
34. Online Payment and Automatic Payment Authorization If Lessee enrolls in autopay or saves a payment method, Lessee authorizes Operator and its payment processors to charge the designated payment method for monthly rent, late fees, returned payment fees, administrative fees, lock fees, cleaning fees, lien fees, auction costs, vehicle/RV fees, electrical charges, heat charges, damage charges, and any other amounts owed under this Agreement.
    Lessee is responsible for expired, declined, invalid, or unavailable payment methods. A failed automatic payment does not excuse late fees, denial of access, default, lien enforcement, or other remedies permitted by this Agreement or Wisconsin law.
35. Website Information Disclaimer The operator attempts to keep website information accurate, including unit sizes, prices, photos, features, access hours, specials, and availability. However, website information may contain errors or may change without notice. Unit dimensions are approximate. A reservation does not guarantee permanent pricing, availability, or acceptance of rental unless confirmed by the Operator and supported by required payment and completed rental documents.
36. Cybersecurity, System Availability, and Gate Access Disclaimer The operator does not guarantee uninterrupted access to the website, online account system, payment system, gate system, cameras, lighting, internet-based services, mobile services, email systems, text
    systems, or other electronic systems. Operator is not liable for damages, delay, loss, access interruption, payment delay, or inconvenience caused by hacking, cyberattack, internet outage, software failure, power outage, payment processor outage, gate malfunction, equipment failure, maintenance, weather, emergency, or other circumstances beyond Operator’s reasonable control.
37. Privacy Policy and Data Use Operator may collect, use, store, and share information necessary to operate the facility and administer accounts, including name, address, email, phone number, driver’s license information, vehicle information, payment information, account history, gate access logs, IP address, device information, surveillance footage, correspondence, and alternate contact information. Information may be used for account administration, payment processing, collections, lien enforcement, fraud prevention, security, legal compliance, customer service, and operational purposes. Operators may share information with payment processors, website providers, software vendors, collection agencies, auction providers, legal counsel, law enforcement, insurers, contractors, and other service providers as reasonably necessary.
38. Surveillance and Recording Consent Lessee understands that the facility may use cameras, gate logs, access control systems, icense plate monitoring, lighting, or other security-related systems. By entering the facility, Lessee consents to monitoring and recording where permitted by law. Security systems are provided for facility operations and do not create a guarantee of safety or protection of stored property.
39. Security Disclaimer Lessee understands that any security features, including gates, fencing, lighting, cameras, locks, access codes, or monitoring, are not guarantees against theft, vandalism, burglary, fire, water damage, weather damage, pests, unauthorized access, or other loss. Lessee stores property entirely at Lessee’s own risk and remains responsible for obtaining insurance.
40. Binding Arbitration and Dispute Resolution ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THIS AGREEMENT, THE WEBSITE, ONLINE SERVICES, PAYMENTS, GATE ACCESS, FACILITY ACCESS, STORAGE SERVICES, STORED PROPERTY, PROPERTY DAMAGE, PERSONAL INJURY, PRIVACY, DATA, COLLECTIONS, LIEN ENFORCEMENT, AUCTION ACTIVITY, OR ANY CLAIM INVOLVING OPERATOR SHALL BE RESOLVED BY FINAL AND BINDING ARBITRATION, EXCEPT FOR CLAIMS THAT MAY BE BROUGHT IN SMALL CLAIMS COURT OR CLAIMS THAT CANNOT BE SUBJECT TO ARBITRATION UNDER APPLICABLE LAW. Arbitration shall occur in Wisconsin, be governed by Wisconsin law, and be conducted before a single arbitrator. The arbitrator shall have authority to determine the interpretation, applicability, scope, and enforceability of this arbitration provision, except where prohibited by law.
41. Jury Trial Waiver LESSEE AND OPERATOR KNOWINGLY AND VOLUNTARILY WAIVE THE RIGHT TO A JURY TRIAL FOR ANY DISPUTE ARISING OUT OF OR RELATING TO THIS AGREEMENT, THE FACILITY, THE WEBSITE, ONLINE SERVICES, OR STORAGE SERVICES, TO THE FULLEST EXTENT PERMITTED BY LAW.
42. Class Action and Representative Action Waiver LESSEE AGREES THAT CLAIMS MUST BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY. LESSEE WAIVES THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, REPRESENTATIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR CONSOLIDATED PROCEEDING, TO THE FULLEST EXTENT PERMITTED BY LAW.
43. Small Claims Exception Notwithstanding the arbitration provision, either party may bring an individual claim in Wisconsin small claims court if the claim qualifies for small claims jurisdiction and is not brought as a class, representative, or consolidated action.
44. Time Limit to Bring Claims Any claim against Operator must be commenced within one (1) year after the event giving rise to the claim occurred, unless a longer period is required by applicable law or this limitation is prohibited by law.
45. Limitation of Damages To the maximum extent permitted by law, the operator shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, loss of business, emotional distress, data loss, loss of use, or diminution in value. To the maximum extent permitted by law, Operator’s total liability shall not exceed the total rent paid by Lessee during the three (3) months preceding the event giving rise to the claim.
46. Indemnification Lessee agrees to defend, indemnify, and hold harmless Prime Security Storage, CRS Rental Properties, LLC, and their owners, members, managers, employees, agents, contractors, vendors, affiliates, successors, and assigns from any claims, damages, losses, liabilities, penalties, fines, costs, attorney fees, injuries, or expenses arising out of or relating to Lessee’s use of the Unit or facility, stored property, prohibited items, hazardous materials, vehicle/RV storage, negligence, violation of law, violation of this Agreement, injury to persons, damage to property, or actions of Lessee’s guests, invitees, agents, employees, contractors, or other persons accessing the facility through Lessee.
47. Force Majeure Operator shall not be liable for delay, interruption, damage, inability to perform, restricted access, or failure of services caused by weather, snow, ice, fire, flood, natural disaster, utility failure, power outage, internet outage, cyberattack, pandemic, labor shortage, governmental action, emergency order, civil unrest, terrorism, supply chain disruption, equipment failure, or other events beyond Operator’s reasonable control.
48. Accessibility Statement Operator intends to provide a website and facility experience that is reasonably accessible. Lessee or website users who experience accessibility issues may contact Operator using the phone number or email listed in this Agreement so Operator can review the concern.
49. Website Intellectual Property All website content, branding, logos, photographs, text, graphics, forms, and materials are owned by or licensed to Operator and may not be copied, reproduced, distributed, or used without written permission.
